External Hosting

This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host. These may include, but are not limited to, IP addresses, contact requests, metadata and communications, contract information, contact information, names, web page access, and other data generated through a web site.

The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of secure, fast and efficient provision of our online services by a professional provider (Art. 6 para. 1 lit. f DSGVO).

Our host will only process your data to the extent necessary to fulfil its performance obligations and to follow our instructions with respect to such data.

In order to guarantee processing in compliance with data protection regulations, we have concluded an order processing contract with our host.

Revocation of your consent to the processing of data

A wide range of data processing transactions are possible only subject to your express consent. You can also revoke at any time any consent you have already given us. Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

Right to demand processing restrictions

You have the right to demand the imposition of restrictions as far as the processing of your personal data is concerned. To do so, you may contact us at any time at the address provided in section “Information Required by Law.” The right to demand restriction of processing applies in the following cases:
  • In the event that you should dispute the correctness of your data archived by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.

Cookies

Contact form

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this information without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 Para. 1 lit. f DSGVO) or on your agreement (Art. 6 Para. 1 lit. a DSGVO) if this has been requested.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular retention periods.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Plug-ins and Tools

Google Web Fonts

To ensure that fonts used on this website are uniform, this website uses so-called Web Fonts provided by Google. When you access a page on our website, your browser will load the required web fonts into your browser cache to correctly display text and fonts.

To do this, the browser you use will have to establish a connection with Google’s servers. As a result, Google will learn that your IP address was used to access this website. Google Maps

Via an API, this website uses the mapping service Google Maps. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To enable the use of the Google Maps features, your IP address must be stored. As a rule, this information is transferred to one of Google’s servers in the United States, where it is archived. The operator of this website has no control over the data transfer.

We use Google Maps to present our online content in an appealing manner and to make the locations disclosed on our website easy to find. This constitutes a legitimate interest as defined in Art. 6 Sect. 1 lit. f GDPR.

6. Custom Services

Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g. via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g. contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6 Sect. 1 lit. b GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6 Sect. 1 lit. a GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6 (1) (a) GDPR) or if statutory data retention requirements preclude the deletion.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. In case of admission, all documents and information from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

Admission to the applicant pool is based exclusively on your express agreement (Art. 6 para. 1 lit. a GDPR). The submission agreement is voluntary and has no relation to the ongoing application procedure. The affected person can revoke his agreement at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for storage.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

Purpose and legal basis of the data processing in accordance with Art. 13 sec. (1) lit. b) GDPR

Personal data is processed for the purpose of fulfilling contracts or for carrying out pre-contractual measures. These include client master data and contacts as well as contact history, quotations, orders, accounts, project data and data referring to other legal obligations of the person responsible.

The legal basis is derived from Art. 6 GDPR. Further important legal bases are derived from the Commercial Code, tax legislation, German company law and other legal provisions
which are relevant for PUR-Systems GmbH. These include contractual rules. Newsletters are processed on the basis of an agreement with those involved.

Data processing is carried out for the safeguarding of the legitimate interests of the person(s) responsible and/or of a third parties in accordance with Art. 13 sec. (1) lit. d) GDPR.

Where necessary, we process your data beyond the actual fulfilment of the contract in order to protect our justified interests or those of third parties. These include:

– Sales management and sales controlling – Assertion of legal claims and defence in legal conflicts – Safeguarding of IT security and of IT operations – Measures for the security of buildings and installations (eg access control) and the observation of domiciliary rights – Measures for business management and development

Categories of persons receiving personal data (data transfer) in accordance with Art. 13 sec. (1) lit e) GDPR.

Within the Federal German Republic, the European Union and the European Economic Area:

Auditors, court bailiffs and other creditors as well as other government agents for compliance with legal obligations and for required certification, logistics operators, clients and suppliers and other business partners.

Third countries including adequacy decisions in accordance with Art. 13 Sec. (1) lit b GDPR

Within the framework of international business relations, data is transferred in accordance with Art. 6 sec. 1 lit b for the fulfilment of contracts and/or the performance of pre-contractual measures. In this case no adequacy decision is necessary.

Duration of storage in accordance with Art. 13 Sec. (2) lit a)

The respective purpose arises from legal requirements and relevant industry-specific regulations. On achievement of the purpose the personal data is deleted.

The rights of those affected in accordance with Art. 13 sec. (2) lit b)

You can make use of your rights at any time via the contact data given above. If your personal data is processed, you are an affected person in the sense of the GDPR and the following rights are available to you where the responsible person is concerned;

The affected person has the right to demand a statement from the responsible person as to whether or not personal data which affects her/him is being processed; should that be the case, then she/he has the right to receive information concerning this personal data and the items of information detailed in Art. 15 of GDPR.

The affected person has the right to demand that the responsible person shall immediately correct any incorrect personal data and, if applicable, complete any incomplete information (Art. 16 of GDPR)

The affected person has the right to demand from the responsible person that personal information concerning her or him shall immediately be deleted when one of the reasons individually detailed in Art. 17 of GDPR applies, for example, if the data is no longer required for the reason given (right to deletion).

The affected person has the right to demand from the responsible person the reduction of the processing personal data if one of the conditions listed in Art. 18 GDPR exists, for example if the affected person has lodged an objection against the processing for the duration of the examination by the responsible person.

The person affected has the right, for reasons which result from their particular situation, to lodge at any time an objection against the processing of personal data which affects them. The responsible person shall no longer process the personal data, unless they can prove urgent justifiable reasons which outweigh the interests, rights and liberty of the affected person or if the processing serves the assertion, exercise or defence of legal claims (Art. 21 GDPR).

Rights of the individuals affected in accordance with Art. 13 sec. (2) lit. c) GDPR

Where you have given us consent for the processing of personal data for specific purposes (eg processing of photographs of the persons affected, the dispatch of newsletter), then the legitimacy of the processing of such data is given on the basis of your consent.

Consent which has been given can be withdrawn at any time with effect for the future. This also applies to the revocation of declarations of consent which were given to us before the entry into validity of the GDPR, ie before 25 May 2018.

Please note that the withdrawal becomes effective in the future. Processing which took place before the withdrawal is not affected by it.

Right of appeal to a regulatory authority in accordance with Art. 13 sec. (2) lit. d) GDPR

Irrespective of any other redress through an administrative appeal or an appeal to a court, each affected person has the right to complaint to an administrative supervisory authority if that person thinks that the processing of the personal data which affects him or her contravenes the GDPR (Art. 7 GDPR.) The person affected can exercise this right through an administrative supervisory body in the member state in which he/she resides, their place of work or the place in which the alleged infringement took place.
